Why Search?

A party that federally registers a confusingly similar mark first, can force the junior party to rebrand entirely once the senior party enters the junior party’s market. Trademark lawyers refer to the junior party as living on borrowed time. A senior party that does not federally register a confusingly similar mark, can only prevent the junior party from entering the geographic area where the senior party has established rights.
